En Punta Arenas a veintisiete días del mes de abril de mil novecientos setenta y ocho y siendo las veinte horas; YO PEDRO ESPINOZA BRAVO, Coronel de Ejército, Comandante del R.I.M.R. Nº10 "PUDETO" de Guarnición en Punta Arenas, casado, carnet de identidad 3.063.238-9 de Santiago en virtud de un extenso examen de conciencia realizado en mi hogar, después de haber conversado con mi familia, libre de presiones en este momento, en mi hogar, me veo en la necesidad imperiosa de exponerlo al Sr. Comandante en Jefe de la V División de Ejército GDD. NILO FLOODY BUXTON, los antecedentes que a continuación voy a detallar y que bajo juramento de honor, de un oficial, de un chileno y por último de un ser humano.

1.- Fui citado a declarar a la Guarnición de Santiago por el Fiscal Ad Hoc del Segundo Juzgado Militar GDB. Don HECTOR OROZCO S.

2.- En la declaración que presté se me obligó a establecer los antecedentes que el Sr. Fiscal estimó conveniente que yo colocara bajo presión que en este momento estimo como incalificable y que en el momento de realizarse estime como una orden. Esta presión consistió en que el Sr. Fiscal realizó las siguientes actividades para amedrentarme y obligarme a decir lo que él quería.

a.- Al llegar al local de la DINE y delante de agentes y suboficiales me indicó una pieza expresándome "Allí incomunicado" con lo cual denigró mi grado y mi jerarquía militar.

b.- Al llamarme a declarar me manifestó que primero y sin testigos quería conversar conmigo. Su conversación consistió en emplazarme en los siguientes términos:

(1) "Coronel ESPINOZA, yo sé toda la verdad y en este momento Ud. tiene solamente dos posibilidades, o me dice toda la verdad y se inculpa como corresponde o simplemente niega todo, ante lo cual prometo que de inmediato cierro el sumario, lo pongo a disposición del Juez Militar para que esto lo ponga a disposición de Investigaciones y se lo lleven e un avión a los EE.UU antes de veinticuatro horas porque su extradición esta pedida con lo cual va a ser juzgado en ese país, sometido a una condena mínima de quince años o más y sin ser socorrido por nadie del ejército de Chile. Al mismo tiempo le advierto que su mujer y sus hijos correrán una triste suerte al verse abandonados en Chile, no garantizándoles su seguridad. Ahora si se decide a contar la verdad, esta tiene que estar en estricto acuerdo con la declaración de MICHAEL TOWNLEY que yo tomé en EE.UU y para lo cual me comprometí con el Fiscal PROPPER, a fin de dejar libre de polvo y paja a su Excelencia el Presidente de la República. Debo advertirle CRL. ESPINOZA que si Ud concuerda con lo declaración de TOWNLEY lo cual creo que hará, de lo contrario está embromado Ud y su familia; Ud tendrá las siguientes garantías en Chile.

-Le otorgaremos el dinero que Ud necesite y que en una cantidad alta, pero adecuada yo le ofrezco.

-Le adquiriremos una casa para que viva su familia.

-Se le condenará a una pena pequeña que no sé cuanto es en este momento.

-La pena podría cumplirla en el Hospital Militar, en el Club de Campo o en una Unidad Militar.

-Su familia podrá visitarlo cuando estime conveniente.

-A la brevedad será dictada una ley de amnistía que le favorecerá.

-Se tratará de completar sus treinta años de servicio y se le otorgará un trabajo adecuado para tener una entrada suficiente. Como Ud puede ver las garantías de decir la verdad "que yo quiero" tiene enormes ventajas y lo favorecen.

3.- En la declaración que presté posteriormente después de haber sido presionado como antes se dijo y ante la falta de apoyo jurídico que en ningún momento el Ejército me ha otorgado, el General Orozco colocó lo que él estimó conveniente basado exclusivamente en la declaración de TOWNLEY la que iba leyendo y extractando lo necesario para inculparme en absoluta concordancia con lo expresado por el Norteamericano. Es así como incluso estableció en la declaración, algo que yo nunca ordené y que reconozco por error, amedrentamiento o presión, firmé en aquel momento y que es el "haber ordenado la eliminación física de ORLANDO LETELIER". Tengo que hacer presente que aquella declaración no tiene validez alguna por cuanto no se me permitió, en ningún momento,incluir ningún concepto ni pensamiento propio, tanto es así, que en un momento determinado cuando el General Orozco me ordenó que colocara "que la orden para eliminar a LETELIER me la había dado el CRL. CONTRERAS, yo quise incluir en esa frase lo siguiente "por encargo del Presidente de la República" el General OROZCO se indignó y no permitió que fuera consignado. Certifico lo anterior con el hecho de que el día Martes 25 estando el General OROZCO con el General CONTRERAS en la oficina del primero fui llamado y el General OROZCO me manifestó lo siguiente:

-Coronel ESPINOZA dígale la General CONTRERAS como Ud inició su declaración.

-Respondí: El Director de Inteligencia Nacional me llamó a su oficina y me dijo por encargo del Presidente de la República hay que efectuar un a investigación sobre ORLANDO LETELIER debido a que está poniendo en peligro la estabildad del Gobierno de Chile."

-Repuesta del General OROZCO, Gracias retírese.

4.- Con respecto a la verdadera misión que recibí en la oficina del Sr. Director de Inteligencia Nacional ella correspondía a que se debía realizar un a investigación a fondo de las actividades del Sr. ORLANDO LETELIER en contra de Chile, contacto con políticos marxistas norteamericanos que propiciaban el bloqueo económico contra Chile, promoción de la liberación interna, presión política de gobiernos occidentales y organismos internacionales en contra del gobierno de Chile, contacto con cubanos marxistas y con FIDEL CASTRO con el objeto de influir en el tirano del Caribe para que enviara un ejército cubano contra de Chile infiltrándolo a través del Perú o cooperándole a este país en una guerra con Chile y no lo que está consignado en mi declaración que solo corresponde a la lectura que el Sr. General OROZCO hizo de la versión que TOWNLEY prestó en su declaración.

5.- Debo agregar además que sin cosiderar la condición de Oficial de Ejército y para continuar ejerciendo una presión hacia mi familia el General OROZCO me envió el día lunes 24 del presente sin mediar orden escrita y motivo justificado bajo arresto domiciliario hasta el día Martes a las nueve y media de la mañana.

6.- Como conclusiones de todo lo anteriormente expuesto quiero expresar lo siguiente:

a.- Fui presionado psicológicamente por el General OROZCO al arrestarme e incomunicarme en una oficina inicialmente.

b.- Fui vejado en mi condición de Oficial Superior al tratárseme descortesmente frente a tropa formada de la DINE.

c.- Fui presionado psicológicamente cuando el General Orozco me expresó que solo había dos caminos a seguir; o me declaraba culpable en Chile o me declaraba culpable en el extranjero, lo que considero una aberración jurídica, un abuso jerárquico y una deslealtad hacia un sub-alterno.

d.- Fui presionado moralmente cuando se me amenazó con la seguridad de mi familia, vale decir de mi mujer y mis hijos.

e.- Fui presionado moralmente cuando se me dijo que se trataba de salvar al Presidente de la República no importara cual fuera el costo siempre que fuera yo.

f.- Fui presionado psicológicamente y moralmente cuando se me ofreció una serie de garantías para mi y mi familia en el caso de declararme culpable.

g.- Fui presionado psicológicamente y moralmente cuando se me expresó que TOWNLEY y FERNÁNDEZ habían dicho la verdad y solo quedaba que yo la dijera.

h.- Fui presionado moralmente a culpabilizar solamente a mi Jefe directo no permitiéndose que responsabilizara también al Presidente de República.

i.- El total de presiones ejercidas sobre el suscrito, las considero vejatorias y hechas con alevosía por cuanto no se me permitió la oportunidad de siquiera defenderme ya que también fui presionado militarmente desde el momento en que se me ofreció la baja inmediata sabiendo que yo cuento solo con 28 años de servicio.

j.- No se me permitió siquiera consultar a un abogado que me hubiese aconsejado en mis declaraciones muy por el contrario de lo sucedido a TOWNLEY a quien el C.N.I. canceló la suma de $150.000 para que el abogado ACUÑA lo defendiera en Chile y canceló una cantidad alta en miles de dólares para que un abogado de gran prestigio en EE.UU lo defendiera hasta el final.

k.- Fui presionado moralmente cuando el General OROZCO manifestó que el proceso al máximo se alargaría siempre que yo me declarara culpable.

7.- Como Us. comprenderá después de de haber analizado los antecedentes ya expuestos considero que moral y jurídicamente mi declaración hecha bajo presión del Fiscal General OROZCO con intimidación sobre mí y mi familia no tienen ningún valor. Y hago presente que como hombre y soldado no me afectaría responsabilizarme de algo, siempre y cuando recibiera la lealtad, la comprensión y la justa valorización de mi sacrificio, pero en estos momentos en que veo que los valores y las virtdes militares se menosprecian y a los hombres que nos sacrificamos por ver libre a esta Patria un 11 de Septiembre de 1973, se nos vilipendia, se nos desprestigia y se trata de separarnos del resto del ejército por habernos jugado la vida en beneficio de aquellos que nunca siquiera estuvieron en la zona de combate, ni enfrentados al más mínimo riesgo, es por esto que deseo dejar testimonio de la actitud dl Fiscal militar y solicitarle a US: considere la presente declaración para ser utilizada cuando el suscrito se la solicite.

AFFIDAVIT

In Punta Arenas, on April twenty-seventh, nineteen seventy-eight, at eight p.m.; I, PEDRO ESPINOZA BRAVO, Army Colonel, Commander of RIMR No. 10, "PUDETS," garrisoned in Punta Arenas, married, Santiago identification card 3,063,238- 9; after an extensive examination of conscience carried out at home, having spoken to my family, being free of pressure at this moment, in my home, find myself in the urgent need of informing the Commander in Chief of the Fifth Division of the Army, Division General NILO FLOODY BUXTON, of the occurrences that are detailed below and which under oath of honor as a soldier of the Chilean Army constitute a denigrating and flagrant violation, in addition to being an abuse of the rights of a man, an officer, a Chilean, and finally, a human being.

1. - I was summoned to testify at the Santiago Garrison by the ad hoc Prosecutor of the Second Military Court, Battalion General HECTOR OROZCO S.

2. - In the testimony I gave, I was forced to verify background information as deemed appropriate by the Prosecutor, which I did under pressure that I now qualify as unspeakable and that at the time I perceived as an order.

This pressure consisted in the Prosecutor carrying out the following activities to intimidate me and to force me to say what he wanted.

a. - Upon arrival at DINE and in front of agents and junior officers, he showed me to a room, stating "over there, incommunicado," by which he denigrated my military rank and hierarchy.

b. - When he called me to testify, he stated that he wanted to speak to me first, without witnesses. His conversation consisted of calling on me on the following terms:

(1) "Colonel ESPINOZA, I know the whole truth, and at this time you have only two options, which are to tell me the whole truth and thus incriminate yourself as appropriate, or to simply deny everything, in which case I promise you that I will immediately close the indictment and put you at the disposal of the Military Judge so that he, in turn, can hand you over to Investigations and put you on a plane to the United States within twenty-four hours, because your extradition has been requested, which means you will be tried in that country and sentenced to a minimum of fifteen years or more in jail, and without the assistance of anyone in the Chilean Army. Also, I warn you that your wife and children will have a sad future, being, as they will be, abandoned in Chile, with no guarantees of safety.

Now, if you decide to tell the truth, it must be strictly concurrent with the statement given to me by MICHAEL TOWNLEY in the U.S., and for which I gave my word to Prosecutor PROPPER, in order to clear His Excellency the President of any dust or dirt. [Notary seal]

I must warn you, COL. ESPINOZA, that if you agree with TOWNLEY's statement - which I believe you will, since otherwise both you and your family are ruined - you will benefit from the following guarantees in Chile:

- We will provide you with the money you need, and which I offer you in a high but adequate amount [sic]

- We will buy a house for you and your family to live in.

- You will receive a minor sentence, the details of which I don't have at the moment.

- You could serve out your sentence at the Military Hospital, at the Country Club or on a Military Unit.

- Your family can visit you when you want.

- A new amnesty law, which will be to your benefit, will soon be issued.

- We will try to round out your thirty years of service and you will be given adequate employment to ensure sufficient income.

- As you can see, the guarantees for telling the truth "that I want" contain enormous advantages that benefit you.

3. - In the statement I subsequently issued under pressure, as stated above, and faced with the absence of legal support, which the Army has never offered me [sic], General OROZCO wrote down what he believed to be opportune, based exclusively on TOWNLEY's statement, which he was reading and extracting from as necessary in order to charge me in absolute concurrence with what was said by the American.

It is thus that he even included in the affidavit something which I never ordered and which I recognize that I erroneously signed at the moment, due to intimidation or under pressure, and which is "having ordered the physical elimination of ORLANDO LETELIER."

I have to point out that the statement is completely invalid, as I was not at any moment allowed to include any idea or thought of my own, to the extent that at a given moment when General OROZCO ordered me to state "that the order to eliminate LETELIER had been issued to me by COL. CONTRERAS, I wanted to include the following phrase in that sentence: "by order of the President," and General OROZCO became indignant and would not allow that to be recorded.

I certify the above by means of the fact that on Tuesday the 25th, when General OROZCO was in his office with General CONTRERAS, I was called in and General OROZCO said the following to me:

"Colonel ESPINOZA, tell General CONTRERAS how you began your statement."

I answered: "The Director of National Intelligence called me to his office and told me that by order of the President we must begin an investigation of ORLANDO LETELIER, who is threatening the stability of the Chilean Government."

- Response of General OROZCO: "Thank you, you may leave."

4. - With respect to the true mission assigned to me in the office of the Director of National Intelligence: it was to initiate an exhaustive investigation of ORLANDO LETELIER's activities against Chile: contact with American Marxist politicians who were espousing an economic blockade of Chile; promotion of internal liberation [sic]; political pressure from Western governments and international organizations on the Government of Chile; contact with Cuban Marxists and with FIDEL CASTRO for the purpose of influencing the Caribbean tyrant to send a Cuban army against Chile; infiltrating the country through Peru or cooperating with Peru in a war against Chile; and not what is recorded in my statement, which is nothing but a version gleaned from General OROZCO's reading of TOWNLEY's version, given in his statement.

5. - I must furthermore add that without consideration of my rank as an Officer in the Army and to continue the pressure on my family, General OROZCO on Monday, the 24th of this month, without written orders or justified reason, had me placed under house arrest until Tuesday at nine thirty in the morning.

6. - As a conclusion to what has been set forth above, I would like to state the following:

a. - GENERAL OROZCO exercised mental duress upon me when he first arrested me and held me incommunicado in an office.

b. - I was humiliated in my rank as a Superior Officer when I was treated discourteously in front of troops in formation at DINE.

c. - I was under mental duress when General OROZCO told me that there were only two choices to make: to enter a plea of guilty in Chile or to enter a plea of guilty abroad, which I believe is a judicial aberration, an abuse of authority and an act of disloyalty towards a subordinate.

d. - I was under emotional duress when the security of my family, that is, of my wife and children, was threatened.

e. - I was under emotional duress when told that this was about saving the President, no matter what the cost, obviously as long as I was the one paying.

f. - I was under mental and emotional duress when I was offered a series of guarantees for my family and myself if I pled guilty.

g. - I was under mental and emotional duress when told that TOWNLEY and FERNANDEZ had told the truth, and that it was now only up to me to do the same.

h. - I was under emotional duress to implicate only my immediate superior, and was not allowed to also allocate responsibility to the President.

i. - The sum total of the pressure exercised upon the undersigned I consider to be humiliating and treacherous, as I was not allowed the opportunity even to defend myself, being under militarily duress, as well, beginning at the moment I was offered immediate retirement, in full knowledge of the fact that I have only been in service for 28 years.

j. - I was not allowed even to consult an attorney to advise me in my statements, very much in contrast with TOWNLEY, to whom the CNI granted the sum of $150,000 so that he could be defended in Chile by the attorney ACUÑA, and which also paid a large amount in thousands of dollars for an attorney of great repute in the U.S. to defend him to the end.

k. - I was under emotional duress when General OROZCO stated that the process would drag on as long as I confessed my guilt. [Note: this doesn't make sense and probably means, "until I confessed."]

7. - As you will understand after studying the background information given here, I believe that emotionally and legally my statement given under duress from the Prosecutor, General OROZCO, with intimidation aimed at me and at my family, is of no value. And I state that as a man and a soldier I would not be affected by having to bear the burden of responsibility for something, as long as I could count on the loyalty, the understanding and the fair evaluation of my sacrifice; but at this moment, when I see that military values and virtues are disrespected, and that we, the men who sacrificed themselves to see this Country liberated on September 11, 1973, are now the object of vilification and disparagement, and attempts are made to separate us from the rest of the Army because we risked our lives for the benefit of those that were never even close to a combat zone, nor ever faced any minimal risk, it is for this reason that I want to leave testimony of the acts of the military Prosecutor and request that you consider this statement to be used as the undersigned has requested.
