STATEMENT: REGARDING DECISION OF THE SUPREME COURT OF CHILE TO LIFT THE SENATORIAL IMMUNITY OF GENERAL AUGUSTO PINOCHET

Yesterday the Supreme Court of Chile has confirmed a lower court's lifting of the immunity which Augusto Pinochet granted himself by naming himself Senator-for-life.

This decision can be added to those taken by courts in Spain, the United Kingdom, France, Belgium, and Switzerland, all of which have held that Pinochet's having been head of state does not make him immune from prosecution for the crimes against humanity of which he is accused.

Yesterday's decision is a step forward. But is does not guarantee that the cases against Pinochet in Chile will go forward as they should. Pinochet will now face new medical examinations required by Chilean law. These exams must be conducted impartially and with the participation of both parties. Irregularities, like those surrounding the medical examinations taken by Pinochet in London, must be avoided.

The decision taken today shows that cooperation between courts and lawyers in different countries can help to overcome the immunity imposed by a regime that has practiced terrorism, systematic torture, and genocide.

States should promote the contribution that international law makes-peacefully and without material cost-to the development of peace, liberty, and human dignity.

While certainly important, the removal of immunity confirmed by yesterdays's decision covers only the cases of 19 people who were detained and tortured during the Pinochet regime, and who remain missing. It should be underscored that there are over a thousand such people. Additionally, over two thousand were killed, and hundreds of thousands were tortured by government officials during Pinochet's regime. It remains impossible to pursue these cases in Chile due to acts of immunity.

The judicial proceedings in Spain continue to follow their normal course. Cases initiated in the United States, Argentina, and various European States also continue forward.

La Corte Suprema de Chile ha confirmado ayer el levantamiento de la inmunidad que Pinochet se dio al nombrarse Senador vitalicio.

Esta decisión se suma a la de los Tribunales de España, Reino Unido, Francia, Bélgica y Suiza que declararon que el hecho de haber sido Jefe de Estado no otorga a Pinochet inmunidad ante los crímenes de lesa humanidad de que está acusado.

La resolución de ayer es un paso adelante. Pero no garantiza por sí misma el desarrollo del procedimiento judicial. Es de desear que los exámenes médicos que se le van a practicar al acusado lo sean de modo imparcial, con participación de las partes a fin de evitar estratagemas como las que quedaron en evidencia en Londres.

La decisión de ayer muestra que la cooperación judicial internacional entre Tribunales de Estado ayuda a vencer la impunidad legada por un régimen que ha practicado el terrorismo, la tortura sistemática y el genocidio.

Los Estados deben impulsar la contribución que la Justicia internacional podría hacer, por medios pacíficos y sin mayor costo material, al desarrollo de las libertades, la paz y la dignidad humana.

Con toda su importancia, el desafuero ayer confirmado se refiere a 19 casos de personas detenidas, torturadas y desaparecidas. Cabe recordar que son más de mil cien las identificadas como tales, más de dos mil otras las asesinadas, centenares de miles las torturadas por los funcionarios del Estado, todos casos que siguen impunes en Chile. El procedimiento judicial en España sigue su curso regular respecto de delitos investigados en esta causa. También siguen adelante los que se instruyen en EE.UU., Argentina y varios Estados de Europa.
